issue with fillet curve

If your curves are not in the same plane, filleting is impossible, as there is no way to construct a single arc that is tangent to both.

Lines are always in the same plane.

I have this problem, too. Coplanar lines always work. Coplanar curves seem to fillet or not fillet at random, even when they can be easily filleted manually in Rhino.
