algorithmic modeling for Rhino

I am using the "Shape In Brep (ShapeIn)" component to speed up a trim and sort process. Given a panelized surface with an intersecting closed surface, ignore those panels outside the closed surface, split the panels that intersect the surface, and group those inside the surface with the split panels inside the surface.

This works well with two exceptions.

There doesn't seem to be any rhyme or reason to why those two panels are considered inside the surface.

Thoughts?

(Given other panelizations and surfaces, I've gotten a similar result.)

this looks like a bug, i don't know if David has seen this in discussions, so maybe posting this with the file in errors and bugs section would help getting an answer.
